Terms of Service

1. Agreement
These Terms of Service (“Terms”) govern access to AlphaGuard’s website, dashboard, scanners, and related software (the “Service”). By creating an account, running a leak check, or paying for a plan, you agree to these Terms on behalf of yourself or the business you represent.
2. The service
AlphaGuard helps rights holders find unauthorized copies of trading indicators, bots, newsletters, and courses, and send takedown or cease-and-desist notices you approve. We provide software and operational tooling. We are not your law firm. Notices we generate are templates based on information you provide; you remain responsible for the accuracy of ownership claims and for deciding whether to approve a takedown.
3. Accounts
You must provide accurate information and keep credentials secure. You are responsible for activity under your account. Notify us promptly at support@alphaguard.live if you suspect unauthorized access. We may suspend accounts that abuse scanners, submit false infringement claims, or interfere with other customers.
4. Your content and licenses
You retain ownership of code, copy, and trademarks you upload. You grant AlphaGuard a limited license to fingerprint, store, and match that material solely to provide the Service (including sending notices you approve). You represent that you have the right to protect the assets you register and that snippets you share do not include third-party secrets or malware.
5. Acceptable use
You may not:
- use the Service to harass people or to take down content you do not own;
- probe, scrape, or overload our systems beyond normal product use;
- resell raw scanner access without a written partner agreement;
- upload live exchange API keys, customer payment data, or anyone else’s personal data you should not have.
6. Plans, billing, and cancellation
Paid plans are billed in advance on a monthly basis through Stripe unless we agree otherwise in writing. Prices are shown on the pricing page and may change with notice for future periods. You may cancel at any time from the Billing tab; access continues through the end of the paid period. Refunds, if any, follow Section 7 and Stripe’s settlement timing.
7. Plan limits, third-party costs, and refunds
Each plan includes the asset, scan-cadence, and assisted-takedown limits shown at checkout. Outside counsel, court filings, investigators, and third-party enforcement agencies are not included unless a separate written quote is approved. We do not guarantee that a platform, host, registrar, or court will remove content. Refund requests are reviewed for duplicate charges, service outages, and applicable consumer law; projected or “prevented” sales are estimates, not guaranteed recoveries.
8. Free leak check
The free check is a preview of the kinds of leaks we find for products like yours. It is not a complete live audit of the entire internet. Paid monitoring is continuous and tied to the assets you register. Preview reports may use simulated or representative findings so you can evaluate the dashboard before paying.
9. Enforcement and platforms
Hosts, Telegram, Discord, Google, and payment networks decide whether to act on a notice. We do not control those outcomes and do not guarantee that every leak will be removed. You authorize us to contact abuse desks and admins using the details in your account when you click Approve.
10. Disclaimers
THE SERVICE IS PROVIDED “AS IS.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, ALPHAGUARD DISCLAIMS WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant uninterrupted monitoring or that every unauthorized copy will be found.
11. Limitation of liability
To the maximum extent permitted by law, AlphaGuard’s total liability for claims arising out of the Service is limited to the fees you paid us in the three months before the claim. We are not liable for lost profits, lost data, or indirect damages, even if we were told they were possible. Some jurisdictions do not allow these limits; in those places, they apply only as far as the law allows.
12. Indemnity
You will defend and indemnify AlphaGuard against claims arising from assets you register, notices you approve, or your breach of these Terms, including false DMCA or copyright claims.
13. Termination
You may stop using the Service at any time. We may suspend or terminate access for non-payment or material breach. Sections that should survive (including 4, 10–12, and 14) remain in effect.
14. General
These Terms are the entire agreement for the Service. If a section is unenforceable, the rest remains. We may update these Terms by posting a new version; continued use after the stated date is acceptance. Governing law is the State of Delaware, USA, excluding conflict-of-law rules, unless a mandatory local consumer law says otherwise.
